General Terms and Conditions (AGB)

1. Conclusion of the Package Travel Contract, Third-Party Services, Scope of Application and Definitions

1.1 Scope of Application / Organizer

as the tour operator (hereinafter referred to as “Organizer”), are exclusively governed by the following General Terms and Conditions in their version valid at the time of travel registration. Deviating general terms and conditions of our customers will not be recognized unless we expressly agree to their validity in writing. These conditions supplement Sections 651a–y BGB as well as Sections 4–11 BGB-InfoV and fill them out.

1.1.1 Conclusion of Contract


With your travel registration, you make a binding offer to the Organizer to conclude the package travel contract.
The package travel contract comes into effect upon receipt of the Organizer's acceptance declaration. This does not require any specific form.

1.1.2 Travel Registrations via the Booking Form on www.zrce.de

1.1.2.1 Booking Request


You can select various travel services from the Organizer's range and submit a binding offer to conclude a package travel contract via the button
“Book Now for a Fee” (Booking Request). Before sending the booking request, you can change and view the data at any time.
The application can only be submitted and transmitted if you accept these contractual conditions by clicking the checkbox
“I have read the Organizer's AGB and agree to their validity.”

1.1.2.2 Receipt Confirmation / Order Confirmation / Contract Confirmation


We will then send you an automatic receipt confirmation by e-mail, in which your booking request
is listed again and which you can print using the “Print” function. The automatic
receipt confirmation merely documents that your booking request has been received by us and does not constitute
an acceptance of the application. The contract is only concluded through our acceptance declaration, which
is sent with a separate e-mail (Order Confirmation).


In this e-mail or in a separate e-mail, but at the latest when the travel services are provided or a booking number is assigned,
the contract text (consisting of booking request, AGB, and order confirmation)
will be sent to you on a durable data carrier (e-mail or paper printout) (Contract Confirmation).
The contract text will be stored in compliance with data protection regulations.

1.2 Registration for Additional Participants


The registration is made by the registrant also for all participants listed in the registration, for whose
contractual obligations the registrant is liable as for his own obligations, provided he has assumed a corresponding
separate obligation by express and separate declaration.

1.3 Travel Confirmation / Deviations


Upon or immediately after the conclusion of the contract, you will receive a written travel confirmation containing all essential
information about the travel services you have booked.


If the confirmation deviates from your registration, the Organizer is bound to the new offer for 10 days.
The package travel contract is concluded on the basis of the new offer if you accept the offer within this period.

1.4 Reservations


Reservations are registrations for trips that have not yet been advertised. They will be converted into firm bookings as soon as and to the extent that the trip is bookable for the desired travel period.

1.5 Third-Party Services (Tickets)


If you only book a ticket from a third-party provider without any additional travel services, the
Organizer acts only as an intermediary for a third-party service. By purchasing mediated tickets,
contractual relationships are established exclusively between you and the respective provider. Please refer to the ticket for the name of the respective provider.

1.6 No Right of Withdrawal


You do not have a right of withdrawal according to § 312g Abs. 2 Nr. 9 BGB (German Civil Code).


2. Payment

2.1 Insolvency Insurance / Security Certificate


To secure customer funds, the Organizer has taken out insolvency insurance with Zurich Insurance plc,
Solmsstraße 27–37, 60486 Frankfurt am Main. A security certificate is included in the confirmation.
In addition, the confirmation specifies the amounts for advance and final payment and, if applicable, cancellation.

2.2 Due Date for Isolated Booking of Accommodation

2.2.1 Deposit


Upon conclusion of the contract, the deposit of 20% of the total price becomes due against the handover of the confirmation
and is payable within 7 days from the conclusion of the contract. The costs for any travel insurance
are due in full together with the deposit.

2.2.2 Final Payment


The remaining price is due 5 weeks before the start of the trip and will be debited when it is certain that your trip – as
booked – will take place and the travel plan (in the case of ticketless travel) or the travel documents will be transmitted to you
as agreed. For short-term bookings (from four weeks before the start of the trip), the entire travel price is due immediately.

2.2.3 Fees


The fees in the event of a cancellation (see Section 7) and processing and rebooking fees (see Section 8)
are due immediately.

2.3 Due Date for Package Tours Including a Flight


For package tours that include a flight, the travel price is due immediately in full upon conclusion of the contract against the handover of the
confirmation.

2.4 Due Date for the Mediation of Tickets and Airport Transfers


When booking only mediated travel services, such as tickets for mediated
events (e.g., festival tickets), or for isolated bookings of an airport transfer, the price is due immediately in full upon conclusion of the contract against the handover of the confirmation.

2.5 Payment to the Organizer

2.5.1 Payment Methods


We offer the following payment methods: PayPal, SEPA direct debit, giropay, SOFORT transfer, credit card, and
payment on invoice.

2.5.2 SEPA Direct Debit Mandate


If and to the extent that the Organizer offers payment via SEPA direct debit, it requires a so-called
“mandate” that allows the debit of your current account with the amount to be paid (deposit and final payment) via direct debit.
The mandate is part of the confirmation.

2.5.3 Credit Card


If and to the extent that the Organizer accepts payment by credit card, it requires your address or, if applicable, the
address of the document recipient as well as your consent to debit your credit card. A transaction fee of 0.7% of the travel price, rounded to whole euros, applies to payments. This does
not apply to payments according to Section 2.6 or for payments via direct debit.

2.5.4 Bank Transfer


You can also pay by bank transfer before the start of the trip. The Organizer requires the first and last name,
the complete address, the telephone number, and the e-mail address of the booker for this.

2.5.5 PayPal / Additional Fees


We offer payment via the payment service provider PayPal as another payment method. For other
payment methods than SEPA basic direct debits, SEPA corporate direct debits, SEPA transfers, and payment cards, the
tour operator is entitled to charge costs incurred by the customer due to the selection of this payment method
as additional fees. The amount of the additional fees will be displayed during the ordering process.

2.6 (deleted)

2.7 Change of Payment Method


Changes to the agreed payment method can only be made up to 6 weeks before the start of the trip and only for outstanding
payments.

2.8 Travel Plan / Travel Documents


If you do not receive the travel plan (in the case of ticketless travel) or, in exceptional cases, the travel documents by no later than
4 days before the start of the trip, please contact us immediately. For short-term bookings or
changes to the trip from 14 days before the start of the trip, you will receive a travel plan via the same method as for
long-term bookings. In your own interest, we ask you to carefully check the travel plan (in the case of ticketless travel) or
the travel documents upon receipt.

2.9 Payment Default / Withdrawal / Reminder Costs


If due payments are not made or not made in full, and you do not pay even after a reminder with a deadline
set, the Organizer can withdraw from the respective contract unless a significant travel defect already exists at that time. In the event of withdrawal from the package travel contract in the sense of
the previous sentence, the Organizer may demand cancellation fees according to Section 7.


If you do not make payments despite their due date, the Organizer also reserves the right to charge a reminder fee of €1.50 for the second reminder. You remain entitled to prove that no or significantly lower costs were incurred.

2.10 Additional Services


Costs for additional services such as obtaining visas, etc., are not included in the travel price unless expressly stated in the service description.


3. Services, Prices

3.1 Contractual Basis


The services contractually agreed upon are derived from the service descriptions (e.g., internet, catalog,
flyers) and the references to them in the confirmation (see Section 1.1 Sentence 2). Before the conclusion of the contract, the Organizer may make changes to the service descriptions at any time, of which the traveler will be informed before booking.

3.2 Executing Airline / Community List


The Organizer is obliged under Regulation (EC) 2111/2005 of 14.12.2005 to inform you at the time of booking about the identity
of the executing airline(s). If an executing airline is not yet determined at the time of booking,
you will initially be informed about the identity of the likely executing airline(s). As soon as the identity is finally established, you will be informed accordingly. In the event of a change of the
executing airline after booking, you will be informed of the change as soon as possible.


The list of airlines subject to an operating ban in the EU (“community list”) can be found at www.lba.de > Frequently Searched > Airlines with Flight Bans.

3.3 Air Transportation


The Organizer points out that direct flights may have stopovers for flight and program-related reasons.
It is strongly recommended to carry money, valuables, technical devices, and medications only in
hand luggage.

3.4 Special Requests, Individual Travel Design

3.4.1 Special Services


The Organizer will make every effort to meet your request for special services that are not listed in the service description (Section 3.1)
(e.g., adjacent rooms or rooms in a specific location), if possible.

3.4.2 Fee for Individually Deviating Travels


A fee of up to €50 per traveler and week will be charged for processing individual trips that deviate from the respective service description.

3.4.3 (repealed)

3.4.4 Rebookings in the Destination Area


For flight and/or hotel rebookings requested by travelers in the destination area, the Organizer reserves the right to charge a reasonable processing fee per person in addition to any additional costs that may arise.

3.4.5 Pets


The transport of pets is only permitted in cases where the service description expressly allows it.

3.4.6 Uniform Catering


Please note that only identical catering services can be booked within a unit. This also applies
to accompanying children.

3.5 Travel Extension


If you wish to stay longer at your holiday destination, please contact your tour guide or the local
representative of the Organizer as early as possible. We are happy to extend your stay if corresponding accommodation and
return transport options are available. The costs for an extension are to be paid immediately on site upon our request.
Please note the tariff conditions associated with your return journey as well as the validity period of any travel insurances
and any required visas.

3.6 Tour Guide, Support


During the offered trips, you will be supported on-site; in most holiday areas by tour guides of the Organizer or by
local representatives of the Organizer (e.g., landlords of holiday apartments). Otherwise, you will find contact details in your travel plan
(in the case of ticketless travel), in your travel documents, or on www.zrce.de.


In case of complaints, please note the special instructions under Section 13.7.2.


4. Special Notes for Holiday Apartments, Holiday Homes, and Campers

4.1 Additional Costs


Consumption-dependent additional costs or those for additional services requested by you are generally not included in the travel price.
Unless otherwise stated in the service description, they are to be paid directly on site.

4.2 Occupancy


The holiday apartment/holiday home/camper may only be occupied by the number of adults and children specified in the service description and listed in the confirmation.

4.3 Arrival and Departure

The specified arrival and departure dates are binding.

4.4 Deposit


Upon handover of the keys, a reasonable amount (deposit) may be required as security for any damages or consumption-dependent additional costs to be paid on site. The repayment or offsetting occurs when the accommodation and inventory
have been returned in proper condition cleaned at the end of the stay.


5. Child Discounts

5.1 Relevant Age


The child's age at the start of the trip is decisive. Regardless, every accompanying child and its age must be specified at the time of booking.

5.2 Scope

Please refer to the respective service description for the scope of child discounts.

5.3 Incorrect Age Information


In the case of incorrect age information, the Organizer is entitled to charge the resulting differences to the correct travel price plus a
processing fee of €50. You remain entitled to prove that no or significantly lower processing costs were incurred.


6. Changes in Services and Prices

6.1 Changes in Services


Changes to essential travel services compared to the agreed content of the package travel contract, which become necessary after the conclusion of the contract and were not brought about by the tour operator in bad faith, are only permitted to the extent that they are not significant
and do not impair the overall structure of the booked trip. Any warranty claims remain unaffected, particularly
if the changed services are defective. The Organizer is obliged to inform the customer of significant
changes in services immediately after becoming aware of the reason for the change. If necessary, he will offer the customer a free
rebooking or a free withdrawal.

6.2 Cruise Trips


In the case of cruise trips, the captain alone decides on necessary changes to the travel time and/or routes, for safety or
weather reasons.

6.3 Price Adjustments


The Organizer reserves the right to change the travel price agreed in the package travel contract in the event of an increase in transportation costs or
charges for certain services, such as port or airport fees, after the conclusion of the contract as follows.

6.3.1 Increase in Transportation Costs

If the transportation costs existing at the conclusion of the package travel contract, particularly fuel costs, increase, the Organizer may increase the travel price according to the following calculation:

  • a) In the case of an increase related to the seat, the Organizer may demand the increase amount from the traveler.

  • b) In other cases, the additional transportation costs demanded by the transportation company per means of transport are divided by the number of seats of the agreed means of transport. The resulting increase amount
    for the individual seat may be demanded by the Organizer from the traveler.

6.3.2 Increase in Charges


If the charges existing at the conclusion of the package travel contract, such as port or airport fees, are increased against the Organizer,
the travel price may be increased by the corresponding proportional amount.

6.3.3 Conditions


An increase according to Sections 6.3.1/6.3.2 is only permissible if more than 4 months lie between the conclusion of the contract and the agreed travel date and the circumstances leading to the increase had not occurred or were not foreseeable for the Organizer before the conclusion of the contract.

6.3.4 Information / Rights of the Traveler


In the event of a subsequent change in the travel price, the Organizer must inform the traveler immediately. Price increases from
the 20th day before the start of the trip are invalid. In the case of price increases of more than 8%, the traveler is entitled to withdraw from the package travel contract without fees or to demand participation in a trip of at least equal value if the Organizer is able to offer such a trip without additional cost to the traveler from its offer. The mutual rights and obligations mentioned in this paragraph also apply in the event of a permissible change of an essential travel service.

6.3.5 Assertion


The traveler must assert these rights immediately after the Organizer's declaration regarding the price increase or change in travel service.


7. Withdrawal by the Traveler Before the Start of the Trip / Cancellation Fees

7.1 Withdrawal Declaration


You can withdraw from the trip at any time before the start of the trip. The decisive factor is the receipt of the withdrawal declaration by the Organizer
(addresses see above under Section 1). You are advised to declare the withdrawal in writing.

7.2 Withdrawal of the Traveler / Non-Attendance of the Trip

The traveler can withdraw from the contract at any time before the start of the trip. The decisive factor for the time of withdrawal is the receipt of the withdrawal declaration by the Organizer.

In the event of withdrawal, the Organizer loses the claim to the agreed travel price. However, the Organizer may demand reasonable compensation according to § 651h BGB, unless the legal requirements for a withdrawal without compensation, particularly due to unavoidable, extraordinary circumstances according to § 651h Abs. 3 BGB, are present.

The amount of compensation is determined according to the following regulations.

7.3 Non-Attendance / Late Appearance / Missing Travel Documents

The regulations regarding withdrawal compensation apply accordingly if the traveler does not attend the trip or cannot take advantage of travel services due to circumstances for which the Organizer is not responsible, particularly due to late appearance, missing or invalid travel documents, or unmet personal entry requirements.

7.4 Isolated Booked Accommodations

If only accommodation is booked and the booking does not constitute a package travel in the sense of Sections 651a ff. BGB, the following flat-rate cancellation costs apply:

  • up to 10 weeks before the start of the trip: 25% of the agreed price

  • up to 8 weeks before the start of the trip: 50% of the agreed price

  • from 7 weeks before the start of the trip and in case of non-attendance: 100% of the agreed price

The customer expressly retains the right to prove that the Organizer has incurred no or significantly lower damage.

The Organizer reserves the right to assert a concretely incurred higher damage instead of the flat rate, provided this is proven.

7.5 Package Tours

7.5.1 General Calculation of Withdrawal Compensation

In the case of package tours, the Organizer may demand reasonable compensation according to § 651h BGB in the event of a withdrawal by the traveler before the start of the trip.

Unless a separate effective compensation flat rate has been agreed upon, the withdrawal compensation is calculated specifically. The starting point for the calculation is the agreed travel price. From this, the actual expenses saved by the Organizer as a result of the withdrawal as well as revenues that the Organizer achieves through an alternative use of the travel services are deducted.

To the extent that the Organizer does not save any or only minor expenses due to already binding obligations to service providers and an alternative use of the travel services is not possible or only partially possible, the withdrawal compensation may accordingly reach the full travel price.

The Organizer will justify the amount of the demanded compensation at the request of the traveler according to § 651h BGB.

7.5.2 Package Tours with Air Transportation

In the case of package tours that include air transportation, flight services are regularly booked bindingly with the respective airline according to the confirmed booking after the conclusion of the contract.

To the extent that the flight prices, transportation fees, or other costs to be paid by the Organizer due to the tariff, rebooking, or cancellation conditions of the respective airline are not or only partially refunded in the event of a withdrawal, these will be taken into account in the calculation of the withdrawal compensation.

This also applies particularly to costs arising from personal, non-transferable, non-cancellable, or only changeable at additional costs flight tariffs.

Any refunds granted to the Organizer or other expenses actually saved as a result of the withdrawal will be credited to the traveler.

7.5.3 Already Bindingly Booked Additional Travel Services

The same applies to other components of a package trip, particularly accommodations, transfers, tickets, festival or event tickets, and other travel services, provided these have been bindingly booked or purchased by the Organizer after the conclusion of the contract.

To the extent that such services are not refundable according to the conditions of the respective service provider and cannot be used or utilized by the Organizer in any other way, the costs arising from this will be taken into account in the calculation of the withdrawal compensation.

Saved expenses, refunds, and revenues from an actual alternative use of the respective travel service will be credited to the traveler.

7.6 Mediated Individual Services / Distinction from Package Travel

For travel services that are expressly mediated only as individual third-party services and are not part of a package trip, particularly for individually mediated tickets, the cancellation and refund conditions communicated at the conclusion of the contract with the respective service provider apply.

If several travel services are part of a uniform package travel contract, the calculation of withdrawal compensation is made according to the provisions of this Section 7 and § 651h BGB.

The mere separate specification of individual price components within a package trip does not lead to these services being treated as independent individual contracts regarding withdrawal.
7.7. Special Regulation for Renting Event Locations and Event Organization

When renting event locations (especially clubs, beach clubs, or comparable event spaces) and organizing and conducting events by BB & TL GmbH (Zrce.de) at the express request of the customer, the following regulations apply, deviating from the general cancellation conditions:

The services invoiced in this context are generally binding and non-cancellable, as they are booked and compensated immediately by BB & TL GmbH (Zrce.de) to third parties (especially location operators, artists, service providers) upon commissioning by the customer.

A free cancellation is only possible within 7 calendar days after the invoice date, provided it is received in writing (e.g., by e-mail) by BB & TL GmbH (Zrce.de). The decisive factor is the time of receipt of the cancellation.

After this period, cancellation is excluded, and the full invoice amount is owed even in the case of non-utilization of the service.


8. Rebooking, Replacement Person

8.1 Rebooking


At your request, the Organizer will, if feasible, make a change to the confirmation (rebooking) up to 31 days before the start of the trip.
Rebookings include, for example, changes to the travel date, travel destination, place of departure, accommodation, or transportation.
A separate fee of €50 per person will be charged for this. Additional costs incurred with service providers (e.g., airlines) will be charged separately. Please also pay attention to the correct spelling of your name.

In addition, the following applies:


  • In the case of a change of transportation, accommodation (except for changes within the booked accommodation), or travel date, the travel price for the changed services will be completely recalculated based on the then applicable prices and conditions.


  • In the case of a change within the booked accommodation (e.g., change of room category, type of catering, or occupancy of the booked room), the price for the changed services will be newly determined based on the prices and conditions underlying the booking so far.


  • Changes after the above deadlines as well as changes beyond the validity period of the service description underlying the booking (Section 3.1) can only be made after withdrawal from the package travel contract under the conditions according to Section 7.5 with simultaneous re-registration.

8.2 Replacement Person


Until the start of the trip, the traveler can demand that a third party enters into his rights and obligations from the package travel contract.
This requires notification to the Organizer.


The Organizer may oppose the entry of the third party instead of the traveler if the third party does not meet the special travel requirements or
if legal provisions or official orders oppose his participation.


If a third party replaces the registered participant, the Organizer is entitled to demand a processing fee of €20 for the processing costs incurred by the participation of the replacement person. Additional costs incurred with service providers (e.g., airlines) will be charged separately. You remain entitled to prove that no or significantly lower costs were incurred due to the entry of the third party.


The registered participant and the replacement person are jointly liable as co-debtors for the travel price and the costs incurred by the entry of the replacement person.


9. Travel Insurance


The Organizer recommends taking out a comprehensive travel insurance package, particularly including a (also bookable separately)
travel cancellation insurance as well as insurance to cover repatriation costs in the event of accident or illness.


10. Withdrawal and Termination by the Tour Operator

10.1 Termination Due to Disturbance


The Organizer may terminate the package travel contract without notice if the execution of the trip is persistently disturbed by the traveler despite a corresponding
warning from the Organizer. The same applies if a traveler behaves in such a way that immediate termination of the contract is justified. However, the Organizer retains the right to the travel price. Any additional costs for
the return transport are borne by the disturber.


However, the Organizer must credit the value of saved expenses as well as those benefits obtained from an alternative use of not utilized services, including any refunds from service providers.

10.2 Withdrawal Before the Start of the Trip

The tour operator can withdraw from the contract before the start of the trip in the following cases:


  • For the package trip, fewer people than the minimum number of participants specified in the contract have registered; in this case, the
    tour operator must declare the withdrawal within the period specified in the contract, but no later than:

    • 20 days before the start of the trip for a duration of more than six days,

    • seven days before the start of the trip for a duration of at least two and a maximum of six days,

    • 48 hours before the start of the trip for a duration of less than two days.


  • The tour operator is prevented from fulfilling the contract due to unavoidable, extraordinary circumstances; in this case, he must declare the withdrawal immediately after becoming aware of the reason for withdrawal.


The Organizer will inform you, of course, if it becomes apparent at an earlier time that the minimum number of participants cannot be reached.
The withdrawal declaration will be sent to the traveler immediately. You will then receive the paid travel price back immediately, at the latest
within 14 days.

10.3 Remedy / Replacement Performance


In cases where the tour operator cannot refuse remedy (§ 651k Abs. 1 S. 2 BGB), the tour operator must provide remedy through an appropriate replacement performance if the travel defect
affects a significant part of the travel services (§ 651k Abs. 3 BGB). A reduction in the value of the
services, if the replacement performance is not equivalent, must be compensated by the tour operator in money (reduction of the travel price).


If the traveler rightly rejects the replacement performance, he may terminate the trip and assert the legal consequences of termination without the need for a termination declaration, or, if continuing the trip, claim reduction and damages.


11. Extraordinary Circumstances, Force Majeure

11.1 Unavoidable, Extraordinary Circumstances


Due to the termination of the package travel contract in cases of force majeure, we refer to § 651h BGB, according to which the tour operator cannot demand compensation
if unavoidable, extraordinary circumstances occur at the destination or in its immediate vicinity that significantly impair the execution of the
package trip or the transportation of persons to the destination.


Circumstances are unavoidable and extraordinary in the sense of this subtitle if they are not under the control of the party invoking them,
and their consequences could not have been avoided even if all reasonable precautions had been taken.

11.2 Travel Notices


Travel notices from the Foreign Office can be found on the internet at “www.auswaertiges-amt.de” as well as at the telephone number (030) 5000-2000.


12. Complaint Notification, Remedy, Reduction, Termination

12.1 Request for Remedy


If a travel service is not provided or not provided in accordance with the contract, the traveler can request remedy. The request for remedy must be addressed to the tour operator
and the description of the defect as well as the request for elimination must be specified in the declaration. The Organizer may refuse remedy
if remedy is impossible (§ 651k Abs. 1 Nr. 1 BGB) or is associated with unreasonable costs considering the travel defect and the value of the affected travel service (§ 651k Abs. 1 Nr. 2 BGB).

12.2 Reduction


The traveler can demand a reduction in the travel price if travel services have not been provided in accordance with the contract and he has not culpably
failed to report the defect immediately (without culpable delay).

12.3 Termination


If a trip is significantly impaired due to a defect and the Organizer does not provide remedy within a reasonable period, the traveler may
terminate the package travel contract – in his own interest and for evidentiary reasons, written form is recommended –
if the traveler cannot be expected to undertake the trip due to a defect for an important reason recognizable to the Organizer.


There is no need to set a deadline for remedy if remedy is impossible or is refused by the Organizer or if immediate
remedy is required.


If the contract is subsequently terminated, the traveler retains the right to return transport. He only owes the Organizer the part of the travel price attributable to the services utilized, provided these services were of interest to him.


13. Liability

13.1 Damages


In the event of a defect, the traveler can demand damages without prejudice to the reduction of the travel price (reduction) or termination, unless
the defect of the trip is based on a circumstance for which the Organizer is not responsible. He can also demand damages for wasted vacation time
if the trip has been thwarted or significantly impaired.

13.2 Contractual Liability Claims


The contractual liability of the Organizer for damages that are not bodily injuries is limited to three times the travel price,

  • a) as far as a damage of the traveler is not caused intentionally or grossly negligently by the Organizer or

  • b) as far as the Organizer is solely responsible for a damage incurred by the traveler due to the fault of a service provider.

13.3 Tortious Liability Claims


For all damage claims against the Organizer arising from tort that are not based on intent or gross negligence, liability for property damage is limited to the amount of three times the travel price.


These liability limits apply per traveler and trip. Any further claims under the Montreal Convention or the Air Traffic Act remain unaffected by the limitation.

13.4 Liability for Third-Party Services


The Organizer is not liable for service disruptions, personal and property damage in connection with services that are merely mediated as third-party services
(e.g., excursions, sports events, theater visits, exhibitions, transportation services to and from the specified departure and destination), if these services
are explicitly and clearly marked in the travel advertisement and the booking confirmation as third-party services so that they are not part of the travel service of the Organizer.

However, the Organizer is liable

  • for services that include the transportation of customers from the specified departure location of the trip to the specified destination, intermediate transportation during the trip, and accommodation during the trip, as well as

  • if and to the extent that a customer's damage is causally due to a violation of the Organizer's duty to inform, clarify, or organize.

13.5 Sports and Holiday Activities


Participation in sports and other holiday activities is your own responsibility. You should check sports facilities, equipment, and vehicles before use.
For accidents that occur at sports events and other holiday activities, the Organizer is only liable if he is at fault. The Organizer recommends
taking out accident insurance.

13.6 Transportation Conditions


As far as specified in the service descriptions (Section 3.1), your travel plan (in the case of ticketless travel) or your travel documents contain tickets from external
transportation companies. Transportation is based on the conditions of the respective transportation company, which are made available upon request.


The rights and obligations of the Organizer and the travelers under package travel law and these detailed travel conditions are not restricted by the conditions of the
respective transportation company.


Each traveler is responsible for their timely arrival at the departure airport unless a delay is due to an intentional or grossly negligent
breach of duty by the Organizer.

13.7 Duty to Cooperate, Complaints

13.7.1 Duty to Cooperate


Each traveler is obliged to cooperate in the event of service disruptions within the framework of the legal provisions to avoid or minimize any damages.

13.7.2 Complaints / Contact Person


If you unexpectedly have grounds for a complaint, this must be reported immediately to the tour operator on-site and remedy requested. Our
tour guide in the sense of Section 3.6 Sentence 1 or the contact person in the sense of Section 3.6 Sentence 2 is also authorized to receive these declarations.


If the tour guide or your contact person is not reachable, please contact the service provider (e.g., transfer company, hotelier, ship's management) or the
Organizer or its local representative. You will find the necessary telephone and fax numbers as well as e-mail addresses in your travel plan (in the case of ticketless travel)
or in your travel documents, in the service description (Section 3.1), or on www.zrce.de.


For damages or delivery delays of travel luggage and goods during air travel, the Organizer strongly recommends reporting this immediately on-site, but no later than within
7 days after discovering the damage for travel luggage, within 14 days for goods since acceptance, in the case of a delay at the latest 21 days after the luggage or
goods have been made available to the traveler, using a damage report (P.I.R.) to the responsible airline. Airlines usually reject
refunds if the damage report has not been filled out.


In addition, the loss, damage, or misdirection of travel luggage must be reported to the tour guide or the local representative of the Organizer.


To the extent that warranty rights are asserted due to this, the deadlines according to Section 14.1 apply. In the case of complaints, guests of
holiday apartments/houses/apartments must immediately request remedy from the contact person specified in the travel plan (in the case of ticketless travel) or in the travel documents.
If this is unsuccessful, please contact the nearest station of the tour guide or the local representative of the Organizer.


If the traveler culpably fails to report a defect immediately, a reduction in the travel price will not occur.

13.7.3 No Acknowledgment of Claims

Tour guides are not authorized to acknowledge any claims.

13.8 Online Dispute Resolution


The European Commission provides a platform for online resolution of consumer disputes at ec.europa.eu/consumers/odr/.
The Organizer is currently not participating in this voluntary procedure for alternative dispute resolution and is not obliged to do so.


14. Deadlines, Recipients, Limitation and Assignment

14.1 Assertion of Claims


Claims due to non-contractual provision of the trip (§§ 651i to 651n BGB) must be asserted against the Organizer at the latest within one month after the contractually stipulated end of the trip.
Excluded from this are claims from § 280 Abs. 1, § 311, § 241 BGB or tortious as well as enrichment claims.
The assertion should be made in writing in your own interest.


After the deadline, the traveler can only assert claims if he was prevented from complying with the deadline without fault. The day of the end of the trip is not counted when calculating
the month deadline.


For the notification of luggage damage, delivery delays in luggage, or luggage loss, see Section 13.7.2.

14.2 Limitation

14.2.1 Two Years


Claims of the traveler according to §§ 651i to 651n BGB for violations of life, body, or health, which are based on an intentional or negligent breach of duty
by the Organizer or a legal representative or vicarious agent of the Organizer, expire in two years.


This also applies to claims for compensation for other damages based on an intentional or grossly negligent breach of duty by the Organizer or a legal
representative or vicarious agent of the Organizer.

14.2.2 One Year

All other claims according to §§ 651i to 651n BGB expire in one year.

14.2.3 Start of Limitation

The limitation according to the preceding paragraphs 14.2.1 and 14.2.2 begins on the day following the contractual end of the trip.

14.2.4 Tortious Action

Claims arising from tort expire in three years.

14.2.5 Suspension


If negotiations are pending between the traveler and the Organizer regarding the claim or the circumstances underlying the claim, the limitation is suspended until the traveler
or the Organizer refuses to continue the negotiations. The limitation occurs at the earliest three months after the end of the suspension.

14.3 Assignment


The assignment of claims against the Organizer is excluded. This does not apply to accompanying family members or co-travelers of a jointly registered group.


15. Passport, Visa, Customs, Currency, and Health Regulations

15.1 Information


The Organizer will inform nationals of the EU member state in which the trip is offered about the provisions of passport, visa, and health regulations as well as any changes before the trip.
Nationals of other states should inquire at the embassies/consulates responsible for them.

15.2 Visa


The Organizer is not liable for the timely issuance and receipt of necessary visas by the respective diplomatic representation if you have commissioned him with the procurement,
unless the delay is attributable to the Organizer. To obtain visas, etc. from the responsible authorities, you should expect an approximate period of
about 8 weeks.

15.3 Personal Responsibility


The traveler is personally responsible for complying with all regulations important for the execution of the trip. All disadvantages, particularly the payment of cancellation costs,
arising from non-compliance with these regulations are at his expense, unless they are due to a culpable false or non-information by the Organizer.

15.4 Travel Documents


Please refer to the service description (Section 3.1) to see whether a passport is required for your trip or if an identity card is sufficient, and please ensure that your
passport or identity card has a sufficient validity period for the trip. Children require their own travel documents.

15.5 Customs and Currency Regulations


Customs and currency regulations are handled very strictly in various countries. Please inform yourself thoroughly and strictly follow the regulations.

15.6 Vaccination Regulations


Various states require certain vaccination certificates that must not be older than 8 days and not older than 3 years (smallpox) or 10 years (yellow fever). Such
vaccination certificates must also be presented to German authorities if you return from certain countries (e.g., Africa, Middle East).


16. General


The invalidity of individual provisions of the package travel contract does not result in the invalidity of the entire package travel contract. The same applies to the present
travel conditions.
